January 24th 2013 Planning Board meeting minutes
Members Present: Maggie Leonard; co-chair, Stephen Enoch; co-chair, Roger Tryon, Larry Klein and Bridget Krans

- Previous meeting minutes: December 13th meeting minutes approved as amended. January 10th meeting minutes approved as amended.
- Flood insurance program: The board discussed what needed to be done for Monterey to be able to participate in the flood insurance program. Building codes state that new construction and modification of existing structures need to move the buildings up a number of feet according to the 100 year flood plan. Larry pointed that houses near the lake would only be able to have a 25 foot house because they would need to be raised 10 feet. Stephen pointed out that new construction does not usually get a variance. Already existing construction is different. Members of the board questioned if you could build in the 100 year flood plain. Larry stated you could if it met FEMA requirements. Maggie explained to the board that you have to adopt a flood plain map at the town meeting. FEMA generates the map that has to be
adopted as the federal insurance rate map. Insurance is mandatory for mortgages backed by a federal agency.
- For an individual to qualify for federal flood insurance the town of Monterey has to have an overlay district. The town of Monterey currently does not have a flood plain overlay district. The town has a lake shore district.
- The town has to adopt a Federal Insurance rate map into the bylaw. Doing so brings up some requirements and the board is unclear how this will affect building codes. The board will speak with the town building commissioner about this.
- Solar bylaw draft number five: Maggie implemented the changes that were suggested at the previous meeting. Larry suggested we pass the bylaw through Jeremiah Pollard. The board agreed that draft number five was good.
- Public Meeting: The board is going to hold and informational meeting as required when working on a new bylaw. The meeting will be on March 14th 2013 at 7:00. Maggie will post it in the Monterey News and has already posted it in the required news papers.
- Reports from the board: Maggie is going to have a sit down with the Board of Selectmen about the Attorney General not receiving the appropriate paper work from the town clerk.
- Open Mail: 5th Thursday dinner announcement. Town of Great Barrington Special permit decision.
